It is only of late that some attention is paid to the importance of studies on the South Arabian Diaspora in the Horn of Africa, the African side of the Red Sea, the East African littoral, the Indian subcontinent, the Indian Ocean island groups and Southeast Asia, in throwing new light on (i) the process of Islamization, (ii) the origins of local dynasties, (iii) the problem of trade-routes, and (iv) navigational and maritime techniques and a host of other related problems.

BackgroundThe research shows a growing trend in using an electronic platform to supplement or replace traditional paper-based informed consent processes. Instead of the traditionally written informed consent document, electronic informed consent may be used to assess the research subject’s comprehension of the information presented. By doing so, respect for persons as one of the research ethical principles can be upheld. Furthermore, these electronic methods may reduce potential airborne infection exposures, particularly during the pandemic, thereby adhering to the beneficence and nonmaleficence (...) principle. This scoping review aims to identify the ethics related criteria that have been included in electronic informed consent processes and to synthesize and map these criteria to research ethics principles, in order to identify the gaps, if any, in current electronic informed consent processes.MethodsThe search was performed based on internet search and three main databases: PubMed, SCOPUS and EBSCO. PRISMA Extension for Scoping Reviews : Checklist and Explanation guideline was used to report this work.ResultsOf 34 studies that met the inclusion criteria, 242 essential original constructs were collated, and 7 concepts were derived. Digital content showed the highest percentage of collated original constructs followed by accessibility, comprehension engagement, autonomy, confidentiality, language, and parental consent. Twenty-five new items were synthesized for eConsent criteria which may provide guidance for ethical review of research involving eConsent.ConclusionThe current study adds significant value to the corpus of knowledge in research ethics by providing ethical criteria on electronic informed consent based on evidence-based data. The new synthesized items in the criteria can be readily used as an initial guide by the IRB/rec members during a review process on electronic informed consent and useful to the future preparation of a checklist. Considering the changing face of today’s business environment and the importance of corporate social performance evaluation along with adherence to religious teachings, studies on how social organisations affect societies, mainly Islamic ones, have received much attention in recent years. Corporate social responsibility (CSR) here represents the wide variety of activities, volunteered by business owners and investors as the effective members of societies. In fact, it refers to the duties and responsibilities undertaken by organisations in order to maintain and help their (...) affiliated societies. Adherence to religious components has been further introduced as one of the factors shaping the mode in which people interact in the workplace and social groups. Therefore, this study aimed to investigate the role of religious commitment in social responsibility in Iraq as an Islamic nation. For this purpose, a total of 2500 Muslim employees, working in 75 service organisations (i.e. finance, accounting, insurance and education), were selected as the statistical population in 2022. The data were also collected by standardised questionnaires and then analysed using the Statistical Package for the Social Sciences (SPSS) and Linear Structural Relations (LISREL) software packages. The study results demonstrated that employees’ religious commitment could play a significant positive role in enhancing social responsibility in the organisations concerned (p = 0.28, t = 2.95).Contribution: The study results revealed that managers can take advantage of the positive outcomes of religious commitment in their affiliated organisations by strengthening its components in employees. The positive effects of bolstering religious commitment and social responsibility can thus attract more investors outside organisations and consequently meet employee satisfaction, which deserves greater emphasis in all societies, particularly Islamic ones. Here I use aspects of Phil Graham’s discourse analytical work to examine forms of e/valuations and critically analyse the formulation of truths in the constitution of Artificial Intelligence (hereafter, AI). This paper focuses on two 2019 documents: Ethics guidelines for trustworthy AI (AI HLEG, Citation2019a) and Policy and investment recommendations for trustworthy AI (AI HLEG, Citation2019b). My aim here is to provide a timely contribution to contemporary philosophical–methodological innovations in documenting the constellation of values that are prefigured in human-centric constructions (...) of AI. The analysis is informed primarily by principles from Graham’s distinctive approach to critical discourse analysis (CDA), which I take to be the philosophical study of valuation. In that approach, political economy is taken as a composite formulation of values whereby neo-liberalism is discursively entwined and progressed through a system of principles of e/valuation. This paper presents a roadmap to demonstrate the usefulness of a philosophically grounded interdisciplinary piece of linguistic research through which evaluative semantic categories can be usefully synthesised with CDA to systematically expose the assumptions which underpin current truth claims and values – in this case, about and around the ethics of AI. The COVID-19 pandemic has raised challenges in dealing with information sharing by the public and the authorities. There are two categories of information sharing on social media that are believed to be potentially problematic and unethical: the sharing of personal information of patients and the sharing of fake news or false information. We present a discussion on how the response to the COVID-19 pandemic in Malaysia can be ethically handled in terms of information sharing. It is recommended that the public (...) should cultivate the basic skills to evaluate information and determine its validity. On the other hand, the authorities should refrain from placing the blame on patients to avoid them from being stigmatized. It is crucial that all parties are aware of their ethical duty to ensure only ethical and valid information gets shared on social media. (shrink)

Data hiding and watermarking are considered one of the most important topics in cyber security. This article proposes an optimized method for embedding a watermark image in a cover medium (color image). First, the color of the image is separated into three components (RGB). Consequently, the discrete wavelet transform is applied to each component to obtain four bands (high–high, high–low, low–high, and low–low), resulting in 12 bands in total. By omitting the low–low band from each component, a new square matrix (...) is formed from the rest bands to be used for the hiding process after adding keys to it. These keys are generated using a hybrid approach, combining two chaotic functions, namely Gaussian and exponential maps. The embedding matrix is divided into square blocks with a specific length, each of which is converted using Hessenberg transform into two matrices, P and H. For each block, a certain location within the H-matrix is used for embedding a secret value; the updated blocks are assembled, and the reverse process is performed. An optimization method is applied, through the application of the firework algorithm, on the set of the initial values that generate keys. Using an optimization procedure to obtain keys requires performing lowest possible change rate in an image and maintain the quality of the image. To analyze and test the efficiency of the proposed method, mean-square error (MSE) and peak signal-to-noise ratio (PSNR) measurements are calculated. Furthermore, the robustness of the watermark is computed by applying several attacks. The experimental results show that the value of the MSE is reduced by about 0.01 while the value of the PSNR is increased by about 1.25 on average. Moreover, the proposed method achieved a high-retrieval rate in comparison with the non-optimization approach. (shrink)

BackgroundUncertainty intolerance (IU), the tendency to think or react negatively toward uncertain events may have implication on individuals’ mental health and psychological wellbeing. The Intolerance of Uncertainty Scale-12 (IU-12) is commonly used across the globe to measure IU, however, its’ psychometric properties are yet to be evaluated in Iran with a Persian-speaking population. Therefore, the purpose of this research was to translate and validate the IU-12 among Iranian undergraduate students.Materials and MethodsThe multi-stage cluster random sampling was employed to recruit 410 (...) Iranian undergraduate students (260 females) from the Azad University to complete the IU-12, the Depression Anxiety Stress Scale-2, and the Penn State Worry Questionnaire in a cross-sectional design. In this study, face validity, content validity, construct validity, and concurrent validity were measured and Construct Reliability (CR) and Cronbach’s alpha were used to measure reliability.ResultsThe impact score of the translated IU-12 indicated acceptable face validity (value of impact score was greater than 1.5). The value of Content Validity Index (CVI) and the value of Content Validity Ratio (CVR) were above 0.7 and 0.78, respectively. The values of CVI and CVR indicated the items had acceptable content validity and were deemed essential to the measure. The measurement model analysis showed the measure with two subscales had good fit indices (CMIN/df = 2.75, p < 0.01, RMSEA = 0.07, TLI = 0.94, CFI = 0.95, GFI = 0.94). A Confirmatory Factor Analysis (CFA) indicated the scale was composed of the two subscales found in the English-version of the scale (prospective anxiety and inhibitory anxiety), and no items were removed from the scale. The values of CR (0.86) and Cronbach’s alphas (0.89) showed the measure had appropriate internal consistency.ConclusionThe findings support the psychometric properties of the Persian version of the IU-12. This scale could be used to reliably and accurately measure uncertainty intolerance among undergraduate students in Iran. (shrink)

Motivated by disparities in gun violence, sharp increases in gun ownership, and a changing gun policy landscape, we conducted a nationally representative survey of U.S. adults (n=2,778) in 2021 to compare safety-related views of white, Black, and Hispanic gun owners and non-owners. Black gun owners were most aware of homicide disparities and least expecting of personal safety improvements from gun ownership or more permissive gun carrying. Non-owner views differed. Health equity and policy opportunities are discussed.

This paper examines parallels between contemporary Western and Islamic thought. It will propose that there is congruence between Western and Muslim political thought processes on issues of soft-foundationalism, negative theology, provisional truth claims and religious democracy, in order to offset hegemonic tendencies. This will be illustrated by a concise juxtaposition of the ideas of Davutoglu, Winkel, Sardar, Tariq Ali, Derrida, Foucault, Abdolkarim Soroush, Mohammed Arkoun and others. In the social sciences, namely political science, the neutralization of ideology is also supported (...) in relation to the concern of ideological encroachments into the discipline by William E. Connolly, that echoes Karl Mannheim’s sociology of knowledge. This paper concludes that similar concerns on the relationship between power and knowledge in contemporary Western and Islamic political thought processes are beneficial to the study of Islam and its transformation as a social and political phenomenon. Since 2005, Malaysia has established several biobanks to keep in line with the advancement of biomedical research and development of biobanks in other countries such as the UK and the USA. Despite the establishment of several biobanks in Malaysia, little is known about the informed consent approach in biobanking research and its ethical challenges. This study aims to identify the approach in obtaining informed consent in the Malaysian biobanking for research and explore its ethical challenges. Using non-probability purposive sampling, an (...) in-depth interview with the key informants was conducted in Klang Valley. Based on the interviews, broad consent is the main approach used in obtaining informed consent in biobanking for research in Malaysia and five major ethical challenges were identified. These challenges include the informants’ opinion on the current informed consent approach, understanding participants’ rights, the role of the research ethics committee, biobanking governance in Malaysia, and informants’ knowledge and awareness. It is unfair to conclude that Western and Eastern differences have caused conflict in the practice of counselling, especially in mandated counselling. It is reasonable to assume that without the Western approach and understanding of counselling, the East would still be unable to develop their own theory of helping. How then does one compare different approaches? Such an assessment can be argued clearly from a cultural perspective as in the case of mandated counselling. This paper discusses the influence of culture (...) which has shaped the practice of mandated counselling and the appropriate practice of mandated counselling in a Malaysian setting. Many of the points discussed here are drawn from the data informed by seven informants in a research entitled ‘Mandated Counselling In Malaysia: A Heuristic Phenomenological Inquiry Of Involuntary Participation’. The phenomenon of counselling as originated and practised in the West, which has served as the significant model for the Malaysian style of counselling, is discussed. The concept of guidance and crisis intervention in counselling as practised in Malaysia has shaped the appropriate acceptance of mandated counselling. This paper explores how philosophical inquiry and Critical Discourse Analysis can mutually benefit from each other to produce new methodological and reflexive directions in neo-liberal policy research to examine the phenomenon of 'What is '. Through this we argue that augmenting linguistic analysis with philosophical perspectives develops and supports CDA scholarship more broadly by accommodating the shifting complexity of social problems of ideologically driven inequality that are inbuilt through, in our case, social policy texts. In discussing philosophical-methodological issues, the paper (...) argues for the need to continually adapt CDA to the particular data so as to remain sensitive to and avoid hegemonic tendencies in analysis. Through adopting the principles of a working methodology, we discuss a micro-meso-macro CDA framework that draws on the analytical concepts of movement, metaphorical superfluidity, thematic condensation, and surrealism to conceive of a research approach capable of examining and comprehending evolving discourses of political economies. The most immediate benefit of this framework is its capacity to illustrate how forms of valuations perpetuated by and through policy discourse are the motivational locus of meaning making insofar as they strongly inform the moral underpinning the ideology of economic growth. In their paper ‘Designing AI for mental health diagnosis: challenges from sub-Saharan African value-laden judgements on mental health disorders’, Ugar and Malele focused on the challenges and considerations surrounding the design and implementation of artificial intelligence (AI) and machine learning (ML) technologies for diagnosing mental health disorders in South Africa. Although the authors recognise the application of AI and ML in healthcare, they put forward the challenges, particularly in adopting Wakefield’s hybrid theory, where elements of naturalism and normativism are combined (...) in defining mental disorders. They argue that a generic or universally designed AI or ML would not be appropriate in countries with strong and varied local contexts. Hence, they believe that current and future AI developers should consider the cultural nuances, value systems and contextual factors in designing and implementing AI technologies for mental health diagnosis in Africa. When the authors argue that a universal definition of mental health may not be appropriate in Africa, we would like to offer something in contrast. If nomenclature like the Diagnostic and Statistical Manual of Mental Disorders (DSM) can be widely accepted, why does AI, which relies on these codes, encounter scepticism? This study aims to measure the latent mean difference in perfectionism and marital satisfaction by counseling help-seeking attitudes. The respondents were 327 married graduate students from a research university in Malaysia. An online self-administered questionnaire was used to collect the data. The respondents completed the Almost Perfect Scale- Revised, Dyadic Almost Perfect Scale, Marital Satisfaction Scale, and Attitudes toward Seeking Professional Psychology Help Scale. Confirmatory factor analysis was used to examined the instruments and the results indicated that construct validity were (...) achieved. The latent mean difference in perfectionism and marital satisfaction by counseling help-seeking attitudes were tested using multigroup invariance analysis. The respondents with negative attitudes toward counseling help-seeking reported a higher latent mean in perfectionism but a lower latent mean in marital satisfaction compared to those with positive attitudes toward counseling help-seeking. Given that most of the adults’ life is spent in the workplace, and because the quality of working life has a significant effect on family life and community health, it is crucial to study the components involved in the improvement of the workplace and people’s health in the work environment. Therefore, by examining the common literature of Islamic values, spirituality and spiritual health, an attempt has been made in this research to explain organisational values and spiritual health in the management (...) of organisations and to analyse the relationship of these variables with each other in Iraq using an Islamic approach. Similar to any other community, an Islamic community requires management proportional to its specific circumstances. In fact, an Islamic community needs a type of management that intertwines with divine and Islamic values and ethical principles and prioritises Islamic ideals. Therefore, this study aims to evaluate the role of organisational values in the improvement of Islamic values of Iraqi Muslims. To this end, 2800 employees selected from 30 oil and chemical compound manufacturing organisations are examined. According to the results, the Islamic values governing the Iraqi organisations play an effective role in the improvement of employees’ spiritual health.Contribution: Divine and religious values and Islamic ethics have always been considered in Islamic communities, where formal and informal procedures are taken into consideration. An Islamic approach to management is combined with Islamic values, behaviours and ethics, and these values affect Islamic administration. Organisations are increasingly involved in what they call ‘ethical dilemmas’, that is, the conditions under which wrongdoing and righteous deeds must be defined once again because the line between right and wrong has blurred more than ever. In general, human beings have special moral characteristics in the individual and personality dimension that shape their thoughts, speech and behaviour. It is possible that the same people in the same position and organisation could be affected differently, and their ideas, speech and behaviour (...) affect the efficiency and effectiveness of the organisation. Ethics can have positive or negative consequences at each organisational level. One of the effective factors on the occurrence of employees’ ethical behaviours is the role of spirituality in the work environment and humility of leaders. The purpose of this study is to investigate the effect of humility of Muslim leaders on the moral behaviours of followers and spirituality at work in Islamic society. The statistical population of the study was 370 Muslim employees of International Islamic University Malaysia. After distributing the questionnaires among the statistical population, 352 questionnaires were returned. The validity of the questionnaires was confirmed by the content validity method, and its reliability was confirmed by Cronbach’s alpha. In this research, the structural equation modeling approach and Amos software were used to analyse the data. All hypotheses were confirmed at a 95% significance level. The results showed that the humility of leaders has a positive and significant effect on spirituality in the workplace and work ethic of followers. Spirituality in the workplace has also a positive effect on employees’ work ethic.Contribution: It is recommended that the officials of organisations should pay attention to spirituality in the workplace and the humility of managers and supervisors towards employees in order to promote work ethics. Further, it can be concluded that organisations can increase the ethical behaviours of employees by promoting the components of organisational spirituality. (shrink)

Ethical consumerism has been dramatically increasing in recent decades, but in service sector, fewer research has been conducted especially in the fast-food industry. In this paper, we determined empirically the consumer perceived ethicality effects on repurchase intentions as well as on word of mouth through brand image partial mediation and customer expertise moderation in fast-food sector. The data were collected from 307 consumers of the fast-food restaurants through self-administered questionnaires. Common method variance and social desirability bias were measured before testing (...) hypotheses, and the data were investigated by SPSS and AMOS 21st version. The empirical results demonstrated that consumer perceived ethicality effects on repurchase intentions directly and through brand image partial mediation indirectly. Moreover, the direct and positive effects of repurchase intentions on word of mouth were experienced. This study generalized the results of previous studies of consumer perceived ethicality conducted in western culture in Pakistani fast-food sector. This study also proposed that firms should tackle ethical concerns at corporate and operational strategy levels to improve consumers’ behavioral intentions. (shrink)

By reaching perfection and closeness to God and reaching the source of the light of existence, man can benefit from his endless mercy. Almighty God is absolute perfection, and nearness to absolute perfection is the main goal of creation. Considering that those who are not God do not have anything of their own, and whatever perfection God’s servants have is originally from God and belongs to him, the closer people get to God, the more they will benefit from God’s mercy. Therefore, in the work environment, this perfection appears in the form of spiritual intelligence and spiritual health based on Islamic teachings and affects organisational variables such as occupational stress. Today, the role of spiritual intelligence is considered an important issue in improving spiritual health, reducing occupational stress and effective social functioning, especially in an Islamic environment, which leads to a better understanding of employees about their job. Therefore, the present study aims to evaluate the effect of spiritual intelligence of Muslim managers on the spiritual health and occupational stress of employees in Islamic organisations in Iraq. The statistical population includes 3422 Muslim managers and employees of 50 service organisations (including finance, education and tourism) in Iraq in 2022. The results of the hypothesis test in Linear Structural Relations (LISREL) shows, spiritual intelligence has a significant effect on spiritual health ( P = 0.885; T = 11.058). On the other hand, spiritual intelligence has a negative and significant effect on occupational stress ( P = -0.763; T = -7.854). Finally, spiritual health also has a negative and significant effect on occupational stress ( P = -0.912; T = -10.134). Contribution: The findings of the research indicate that spiritual intelligence leads to the improvement of spiritual health and as a result reduces occupational stress, especially in an Islamic environment. Soon after the first COVID-19 positive case was detected in Wuhan, China, the virus spread around the globe, and in no time, it was declared as a global pandemic by the WHO. Testing, which is the first step in identifying and diagnosing COVID-19, became the first need of the masses. Therefore, testing kits for COVID-19 were manufactured for efficiently detecting COVID-19. However, due to limited resources in the densely populated countries, testing capacity even after a year is still a limiting (...) factor for COVID-19 diagnosis on a larger scale and contributes to a lag in disease tracking and containment. Due to this reason, we started this study to provide a better cost-effective solution for enhancing the testing capacity so that the maximum number of people could get tested for COVID-19. For this purpose, we utilized the approach of artificial neural networks (ANN) to acquire the relevant data on COVID-19 and its testing. The data were analyzed by using Machine Learning, and probabilistic algorithms were applied to obtain a statistically proven solution for COVID-19 testing. The results obtained through ANN indicated that sample pooling is not only an effective way but also regarded as a “Gold standard” for testing samples when the prevalence of the disease is low in the population and the chances of getting a positive result are less. We further demonstrated through algorithms that pooling samples from 16 individuals is better than pooling samples of 8 individuals when there is a high likelihood of getting negative test results. These findings provide ground to the fact that if sample pooling will be employed on a larger scale, testing capacity will be considerably increased within limited available resources without compromising the test specificity. It will provide healthcare units and enterprises with solutions through scientifically proven algorithms, thus, saving a considerable amount of time and finances. This will eventually help in containing the spread of the pandemic in densely populated areas including vulnerably confined groups, such as nursing homes, hospitals, cruise ships, and military ships. The Malaysian government recognises the potential contribution of biotechnology to the national economy. However, ongoing controversy persists regarding its ethical status and no specific ethical guidelines have been published relating to its use. In developing such guidelines, it is important to identify the underlying principles that are acceptable to Malaysian society. This paper discusses the process of determining relevant secular and Islamic ethical principles and establishing their similarities before harmonising them. To achieve this, a series of focus group discussions were (...) conducted with 23 knowledge experts representing various stakeholders in the biotechnology community. Notably, several principles between the secular and Islamic perspectives are indirectly or directly similar. All the experts agreed with the predominant six ethical principles of secular and Islamic philosophy and their importance and relevance in modern biotechnology. These are beneficence and non-maleficence as the main or overarching principles, the preservation of religious and moral values, the preservation of the intellect and the mind, the protection of human safety, the protection of future generations, and protection of the environment and biological diversity. Several adjustments were made to the terminologies and definitions of these six principles to formulate acceptable guiding principles for the ethics of modern biotechnology in Malaysia. These can then be adopted as core values to underpin future national guidelines on modern biotechnology ethics. These principles will be particularly important in guiding the policy makers, enforcers, industries and researchers to streamline their activities. In so doing, modern biotechnology and its products can be properly managed without jeopardising the interests of the Muslim community as well as the general public. Importantly, they are expansive and inclusive enough to embrace the religious sensitivity of diverse quarters of Malaysia. (shrink)

As with many other countries, Malaysia is also developing and promoting biomedical research to increase the understanding of human diseases and possible interventions. To facilitate this development, there is a significant growth of biobanks in the country to ensure continuous collection of biological samples for future research, which contain extremely important personal information and health data of the participants involved. Given the vast amount of samples and data accumulated by biobanks, they can be considered as reservoirs of precious biomedical big (...) data. It is therefore imperative for biobanks to have in place regulatory measures to ensure ethical use of the biomedical big data. Malaysia has yet to introduce specific legislation for the field of biobanking. However, it can be argued that its existing Personal Data Protection Act 2010 has laid down legal principles that can be enforced to protect biomedical big data generated by the biobanks. Consent is a mechanism to enable data subjects to exercise their autonomy by determining how their data can be used and ensure compliance with legal principles. However, there are two main concerns surrounding the current practice of consent in biomedical big data in Malaysia. First, it is uncertain that the current practice would be able to respect the underlying notion of autonomy, and second, it is not in accordance with the legal principles of the PDPA. Scholars have deliberated on different strategies of informed consent, and a more interactive approach has recently been introduced: dynamic consent. The Iraqi constitution of 2005 grants freedom of religious thought, belief and practice for all religions. This study was also based on the premise that the constitutional rights are not adhered to in Iraq, even by government officials, which could be due to the absence of suitable legislations subsequent to the framing of the constitutional provisions. An analytical and descriptive research design was adopted for this study. Data was collected from primary and secondary sources through documentation research and evaluation of (...) historical sources. The primary data comprised Articles of the Iraqi constitution, and a few national and international legal instruments related to religious freedom. Secondary data included empirical research studies, books, articles and other published sources. This study therefore took the form of an empirical legal research as it involved the issues of constitutional reforms in the field of religious freedom. A comparative approach was adopted in analyzing the documents about religion and politics related to both the Arab region and the West. The focus was on the measures that should be adopted to advance the dialogues of religious freedom and maintain religious neutrality in all government policies. The study found out that there were apparent contradictions between the constitutional provisions and the State Laws. Similarly, the Iraqi civil and penal codes remain silent regarding legal remedies for the violation of constitutional provisions. (shrink)

Essays on linguistics in Malaysia; festschrift in honor of Asmah Haji Omar, a doctor in linguistics at Universiti Malaya.

The term non-governmental organisations (NGOs) has been well-known for the development of human rights, charity works and organisational developments. On the other hand, some NGOs also have their specialised roles to help the community such as in conflict resolution, cultural preservation, policy analysis and information provision. Apart from that, there are many categories of NGOs: Islamic-oriented non-governmental organisation (IONGOs), faith-based organisation (FBO), humanitarian NGOs (HNGOs) and government organised NGOs (GONGOs). However, in this research, the researchers focus on how IONGOs compare (...) with NGOs in assisting the lesbian, gay, bisexual, and transgender (LGBT) community based on four hijrah NGOs: Persatuan Islah Movement, Persatuan Insaf Pahang, Hijrah Republique Network and Usrah Iqrak. These four NGOs were chosen because of their roles in assisting the LGBT community. In this research, the researchers adapt the qualitative research by using a case study method; phenomenological approaches and a document analysis have also been applied as well. The result shows that these four IONGOs are different from the NGOs based on the seven typologies applied: intersection, distinct, substantive, subset, co-existing, atomistic grouping and constitutive. The implications of this article highlight the fact that IONGOs are different from the LGBT NGOs in Malaysia as they focus more on spirituality and an Islamic pathway. Hence, future research should include focus group interviews with all the members in NGOs that assist the LGBT hijrah in the community. Caricatures can help to understand the perception of a face. The prominent facial feature of a subject can be exaggerated, so the subject can be easily identified by humans. Recently, significant progress has been made to face detection and recognition from images. However, the matching of caricature with photographs is a difficult task. This is due to exaggerated features, representation of modalities, and different styles adopted by artists. This study proposed a cross-domain qualitative feature-based approach to match caricature with a (...) mugshot. The proposed approach uses Haar-like features for the detection of the face and other facial attributes. A point distribution measure is used to locate the exaggerated features. Furthermore, the ratio between different facial features was computed using different vertical and horizontal distances. These ratios were used to calculate the difference vector which is used as input to different machine and deep learning models. In order to attain better performance, stratified k-fold cross-validation with hyperparameter tuning is used. Convolution neural network-based implementation outperformed the machine learning-based models. (shrink)

The Yazidi community is one of the largest minority groups in Iraq, who have suffered the most. They have been subjected to marginalization and trauma for decades, which has not been documented adequately in the past. The study adopted a descriptive exploratory research to collect and investigate historical evidence regarding the marginalization and traumatic experience of the Yazidi minority in Iraq and explore whether the western secularism could be helpful in achieving restorative justice and rehabilitation. Through the study of available (...) data in interdisciplinary sources, an attempt was made to fill the literature gap. The current study perceived whether the western so-called secularism could be effective in bringing reconciliation of the Yazidi minority with the Government of Iraq and the KRG. The study also found out that the Yazidi community does not need a European-style revolutionary and atheistic secularism which does not recognize any social, religious or political affiliation in the name of democratic principles. What the Yazidi community needs is a region specific, US-led political-religious initiative, equipped with principles of non-violence, peaceful coexistence, justice, and accessibility to equal human rights and a shared vision along with the majority of the Iraqi population and recognition by the KRG, failing which the Yezidi will continue to be considering themselves as a separate ethnic group and represent as the failure of western secularism. The science of wakf-ibtidâ, whose practical reflections we observe from the Prophet himself, draws attention as an important subject that the companions also referred to, within the framework of the interpretation of the word "tertîl" in the verses where Allah orders the Qur'an to be read with tertîl. In the following period, this science, which was considered among the sub-disciplines of the science of recitation, both in the Qur'anic recitation-themed works and in the interpretations of commentators, was included in chapter, (...) section or special parts. Because wakf and ibtidâ are extremely important for the interpretation of the Quran as well as for the science of recitation. Namely, "wakf", which means stopping reading and breathing at a place where the meaning is complete, and "ibtidâ", which means continuing to read from a place that is suitable for the integrity of the meaning, is an indispensable discipline due to its direct relevance in the correct manifestation of the meaning of the Quran. In addition, wakf-ibtidâ, which performs an undeniable function in regulating the recitation of the reader, stands out as a science that scholars cannot remain independent of in this respect. One of the scholars in question is Mekkî b. Ebî Talib (d. 437/1045). He is a scholar of recitation who has guided the literature with his writings throughout the historical process of the science of recitation and is among the most distinguished names in the field, and has also influenced the subsequent literature with his attitude towards the basic issues of this science. Based on this reality, in this study, Mekki's approach to the science of vakf-ibtidâ will be examined specifically in his commentary named al-Hidaye ila bülüği'n-nihâye. In this context, first of all, a brief definition of the concept will be made, and the method of scholars' compilation of the mentioned science and the resulting classifications will be touched upon. Then, Mekki's classification logic in this discipline, the original concepts he used in this regard, and the words he subjected to special criticism will be discussed. In addition, the names he used will be contacted and the tradition he followed within the framework of the subject will be tried to be determined. (shrink)

Mu'tazila and Shīʿa (Zaydiyya-Imāmiyya) have common views on many theological issues except the imamate. This issue has been generally accepted by other Islamic scholars rather than Shīʿa and by Western researchers. That in this interaction between the Mu‘tazila and the Shīʿa, the Shīʿa is the side mostly affected. However, it is an issue that should not be overlooked that the Shīʿa partially influenced the Mu'tazila in ʿAlī b. Abī Ṭālib, over the other Companions. In this context, some persons from the (...) Baghdad Mu’tazila School such as Bishr b. al-Muʿtamir (d. 210/825), Jaʿfar b. Mubashir (d. 234/848), Jaʿfar b. Harb (d. 236/850) and al-Iskāfī (d. 240/854) argued that the imamate of Abū Bakr, who was less virtuous, was permissible although they considered ʿAlī as the most virtuous person after the Prophet. In addition, al-ʿAllāf (d. 235/849-850), al-Naẓẓām (d. 231/845), Abū Abdullah al-Basrī (d. 369/979-80) and Qāḍī ʿAbd al-Jabbār (d. 415/1025) along with Abū ʿAlī al-Jubbāʾī (d. 303/916), one of the chiefs of the Basra Mu'tazila School, and Abū Hāshim al-Jubbāʾī (d. 321/933) did not accept the order of caliphate as the order of virtue. This study focuses on the issue of whether the aforementioned affinity between Mu'tazila and Shīʿa affected Mu'tazila, especially in the interpretation of the verses associated with ʿAlī. In the study, the aforementioned problem was examined through the tafsīr al-Kashshāf of the Muʿtazilī mufassir al-Zamakhsharī (d. 538/1144). In addition to the importance of tafsīr, the fact that al-Zamakhsharī took lessons from Shīʿīte/Zaydī persons and he wrote the tafsīr with the support of Zaydī leader al-Wahhās (d. 506/1112) is effective in handling this issue through al-Kashshāf's tafsīr. In the first part of the study, first of all, the interaction between Imāmiyya and Zaydism, which are the two most important branches of Mu‘tazila and Shīʿa, is briefly mentioned. Then, Mu'tazila’s and Al-Zamakhsharī’s view on ʿAlī's position among other caliphs is emphasized. Al-Zamakhsharī, who is from the Basra school of the Mu'tazila, does not consider ʿAlī b. Abī Ṭālib superior to Abū Bakr, unlike al-ʿAllāf, Abū ʿAlī al-Jubbāʾī, Abū Hāshim al-Jubbāʾī and Qāḍī ʿAbd al-Jabbār, who are the leading figures of this school. In fact, the fact that he always observed the order of the caliphate while talking about the merits of the four caliphs supports the possibility that, unlike his predecessors, he accepted the order of the caliphate as the order of virtue. In the second part, it is questioned whether the narrations that al-Zamakhsharī included in his tafsīr of the verses associated with ʿAlī are similar to the narrations of the Shīʿīte/Zaydī/Imāmī tradition and whether he interpreted the verses in parallel with these narrations. In this respect, the tafsīr al-Kashshāf has been examined comparatively with the Sunni and Shiite tafsīrs prior to it. Eventually, while interpreting these verses associated with the Ahl al-bayt (members of the Prophet’s household), al-Zamakhsharī highlights the narrations that appreciate the virtues of ʿAlī b. Abī Ṭālib and his child. However, he also refrains from making comments that would be in line with the Shīʿa's belief in imamate. In particular, his tafsīr of the verse al-Aḥzāb 33/33 in the context of the Prophet’s wives is the greatest indicator of this situation. It has been determined that while al-Zamakhsharī includes the narrations highlighting the virtue of ʿAlī b. Abī Ṭālib and his children, he mostly follows the Sunni commentator al-Thaʿlabī. In particular, it has been seen that al-Zamakhsharī transferred the narration material in the interpretation of the relevant verses from al-Thaʿlabī's commentary almost in the same way. However, it is noteworthy that al-Zamakhsharī differs from him in some details such as linguistically supporting these narrations in some verses such as ʾĀli ʿImrān 3/61 and al-Māʾidah 5/55. An indirect influence can be mentioned because al-Thaʿlabī frequently narrates the narrations supporting the Shīʿītes in places where there is a Sunni-Shīʿīte conflict. Therefore, although there is no evidence that al-Zamakhsharī took these narrations from Shīʿīte sources, it is seen that he brought ʿAlī b. Abī Ṭālib-based narrations in Sunni sources into the fore. Even in the commentary of al-Ḥākim al-D̲h̲us̲h̲amī, al-Zamakhsharī's teacher in the line of Zaydi/Mu'tazili, the lack of Ali emphasis in the interpretation of the aforementioned verses supports our view. The book under study is "Kitāb al-Uṣūl" and its commentary "Sharḥ al-Uṣūl" written by Ibn Ḥallād al-Basrī, one of Abū Ḥāshim al-Jubbāʾī's leading students. This work is the result of the Mu'tazilite Manuscripts Project conducted by Sabine Schmidtke and D. E. Sklare, and has been published in an edited edition by Camilla Adang, Wilferd Madelung, and Sabine Schmidtke. The study, entitled "-A Critical Edition of the Ziyādāt Sharḥ al-uṣūl by the Zaydī Imām al-Nāṭiq bi-l-ḥaqq Abū Ṭālib Yaḥyā b. al-Ḥusayn b. (...) Hārūn al-Buṭḥānī " begins with quotations from Ibn Ḥallād's Kitāb al-uṣūl or its incomplete commentary, Sharḥ al-uṣūl. This is followed by various quotations written in addition to Ibn Ḥallād's incomplete commentary, which are mostly from Kādī ʿAbd al-Jabbār's Sharḥ. Then the commentary of the Zaydī Imam Nāṭīq-Bilḥāq is added, and finally, the text is completed by the commentary of his student and annotator, Abū al-Ḳāsīm Aḥmad b. Mahdī al-Ḥasan. Although the text does not directly define the usūl al-hamsa, the reader can recognize this progression. Beginning with tawhid, the text moves on to justice, followed by va'd-va'id, and finally concludes with topics such as predestination, sustenance, accident, and fate. (shrink)

One of the most important issues that distinguishes the Baghdādī branch of the Muʿtazila from the Baṣran branch is their view on ʿAlī b. Abī Ṭālib (d. 40/661). Basra branch accepts the order of virtue of the first four caliphs as their order of coming to office, while the Baghdad branch considers the first three caliphs legitimate, but considers Ali more virtuous than them. The Baghdādī Muʿtazilīs who outspokenly defended this idea were Abū Jaʿfar al-Iskāfī (d. 240/854), Abū al-Qāsim al-Kaʿbī (...) (d. 319/931) and Ibn Abī al-Ḥadīd (d. 656/1258). Among them, Ibn Abī al-Ḥadīd was renowned as “the greatest scholar of the Muʿtazila” and was considered one of the last representatives of this school. He ardently defended ʿAlī's superiority in his commentary on Nahj al-Balāgha, the famous collection of Ali’s sermons, letters and wisdom sayings. In his defense, he rebutted some criticisms about ʿAlī’s political decisions from his school’s point of view. Many items of Ibn Abī al-Ḥadīd’s rebuttal are worthy of analysis in terms of their content, style and approach. This article aims to present a detailed account of Ibn Abī al-Ḥadīd’s aforementioned refutations. In addition to the descriptive method, the interpretative method was also employed in the article. Although Ibn Abī al-Ḥadīd did not consider Ali's infallibility necessary (wājib), unlike Imamiyya, he accepted it. Therefore, he responded to the criticisms directed at Ali, starting from the point of Ali's innocence. According to Ibn Abī al-Ḥadīd: (a) After the death of the Prophet, ʿAlī insisted on becoming the new leader of the Muslim community. He did not act hastily to assume the caliphate because he was not expecting any opposition to that. However, when the events took a different turn, he did not escalate the situation, rather accepted the status quo. (b) ʿAlī also did the right thing by participating in ʿUmar b. Al-Khaṭṭāb’s (d. 23/644) electoral shūrā. This was an opportunity for him to become the next caliph, and reinstitute a system in accordance with the Qurʿānic principles and sunna of the Prophet. (c) It was also not an error when ʿAlī decided to stay in Medina during the events of ʿUthmān’s murder (d. 35/656). He played an active role in dissuading the rebels from their attempt to kill ʿUthmān, but he was in no position to know that his activity would be used against him later by the Umayyads who accused ʿAlī of being complicit in ʿUthmāns’s murder. (d) ʿAlī took the caliphate after ʿUthmān because of his popularity among the people. In this way, he managed to prevent an unqualified person to occupy the seat of the caliphate. (e) When the Battle of Camel broke out, those who demanded justice and opposed ʿAlī were in error. (f) When ʿAlī became the new caliph, his decision to remove Muʿāwīya (d. 60/680) from the governorship of Syria was correct. This is because Muʿāwīya would have refused to accept ʿAlī’s leadership even had he stayed in office as a governor. ʿAlī understood that the conflict would end only through fighting, so he did not lose time in marching against Muʿāwīya. (g) During the battle he abided by the sharīʿa and allowed the Syrian army to access water. (h) It was not ʿAlī, but those defectors in his army who obliged him to end the fighting through arbitration. (i) When ʿAlī agreed to sign the Ṣiffīn ceasefire agreement and did not use his title amīr al-muʾminīn, he followed the Prophet's example since the latter also refrained from using his title during the Ḥudaybiyya agreement. (j) ʿAlī also cannot be blamed for those among his supporters, such as the poet al-Najāshī, who defected and joined the ranks of Muʿāwīya. The motivations for the defectors were either to attain worldly gains or to escape from punishment for the crimes which they had committed. (k) When Muʿāwīya managed to conquer Egypt, ʿAlī’s governors of the province, Qays b. Saʿd (d. 60/680) or Muḥammad b. Abī Bakr (d. 38/658), did nothing for which they could be blamed. (l) And finally, ʿAlī never had guards to protect him because he was never afraid of being assassinated. Although Ibn Abī al-Ḥadīd took Ali's innocence as a basis while presenting these views, he did not make inconsistent comments in general and did not say things contrary to historical facts. Şiâ’nın temel inanç ilkelerinden biri olan ricʿat doktrini potansiyel olarak radikal yorumlara olanak sunmaktadır. Ricʿat inanışının arka planında gaybet anlayışı ve ona yüklenen insan üstü özel mana son derece hayati öneme sahiptir. Şiîlik içerisinde günümüze ulaşan ve Şiîlerin büyük çoğunluğunu oluşturan İmamiyye ya da On iki İmam (İsnâ aşeriyye) Şiîliğine göre, on ikinci imam Muhammed b. el-Hasan, 941 yılında büyük gaybete gitmiştir. Bu doktrinle, gizli imamın bir gün geri döneceğine, zulüm ve haksızlıklarla dolu olan tüm dünyayı adaletle hükmedeceğine ve refaha (...) ulaştıracağına inanılır. Esasında ricʿat inanışıyla ilgili ortaya atılan iddiaları daha erken dönemlere götürmek mümkündür. İslam tarihinin erken dönemlerinde, Ali b. Ebi Talib (ö. 40/661) ve oğlu Hüseyin (ö. 61/680) gibi önemli şahsiyetlerin ölümsüzlüğünü iddia eden bazı radikal mezhepler (gulât) ortaya çıkmıştır. Onuncu yüzyıl da yine Şiîler arasında gaybette olduğuna ve tüm insanlığa rehberlik etmek üzere bir gün yeniden ortaya çıkacağına inanılan gizli imam Muhammed b. el-Hasan'ın dönüşüne dair bu tür iddialara sahne olmuştur. Bu çalışmada Şiâ içerisinde ortaya çıkmış üç alt grup olan Nusayrîler, Dürzîler ile Bâbî ve Bahâîler’in ricʿat doktrinine yükledikleri anlam incelenmektedir. İlk ikisi eş zamanlı olarak onuncu yüzyılda, Bâbî ve Bahâîler ise on dokuzuncu yüzyılda ortaya çıkmıştır. Ricʿat doktrinine yaklaşımda bâb kavramının aracılık görevini üstlendiğini ifade etmek gerekir. Nusayrî fırkasının kurucusu Muhammed b. Nusayr en-Nemîrî (ö. 270/883), kendisini on birinci ve on ikinci imama açılan kapı olarak ilan ederek ricʿat doktrinine ezber bozan bir yaklaşım ortaya koymuştur. Buna ilaveten, tanrının ruhunun Hz. Ali’nin bedeninde zuhur ettiği, sonrasında da bu ruhun on ikinci imama gelinceye kadar imamların bedenlerine intikal ettiği inancı yayılmıştır. Dürzîler bâb kavramından ziyade doğrudan Hakim Biemrillah’ın ulûhiyyetine odaklanmışlardır. Bâbî ve Bahâîler ise bâb kavramı temel olmak üzere mehdilik ve yeni bir din olma iddiasıyla ricʿat doktrinini te’vil etmişlerdir. Özellikle Nusayrî ve Dürzîler ricʿat inanışını yorumlayarak bunu hulûl ve tenasühe dönüştürmüşlerdir. Bâbî ve Bahâîler ise nübüvvet vazifesinin Hz. Muhammed ile son bulduğu inanışını reddederek ricʿat anlayışını nübüvvete dönüştürmüşlerdir. Böylece onlar, önceki dinlerin hükümlerini ortadan kaldıran yeni bir din olma iddiasında bulunmaktadırlar. Bu çalışmanın amacı, Şiîlik içerisinden neş’et ederek ortaya çıkmış yukarda adı geçen mezheplerin ricʿat doktrinine nasıl yaklaştıklarını ve bu olguyu ne olarak yorumladıklarını ortaya koymaktır. The main purpose of the present paper is to introduce and explicate the position and services of the most brilliant character –Etemad-Al-doleh of the ruling era of Shah Abbass the first called Khajeh Mirza Hatam Beig Ordoobadi and his son-Talib Khan. Due to Shah's authority in this era, the paramount duty which can be assigned to the position of Etemad-Al-doleh was to control the geostrategy and military actions.After Shah Abbass, the first-and due to the fact that the kings were (...) brought up in seraglios and were far from gaining experience to manage the country, Etemad- Al-doleh developed his position so increasingly. According to the historical sources belonging to the Safavid era and itinerary of European, we can easily find out that Etemad-Al-doleh found his way into any governmental affairs. Based on the outstanding position of Hatam Beig and his son, it can be claimed that the social position is not considered just to promote the military officers ' ranks in Shah- Abbass era. Unlike the Safavi's point of view, the term of virtue- centered community was limited to recruiting the Georgian servants called "the establishment of the third military force". In the first decades, Etemad-Al-doleh enjoyed a valid social position and a proper background in tribunal. Studying the lives of supreme ministers shows us that the majority of them had court-based and military social origins. (shrink)

Edition and study of P.Vindob. A.Ch. 36616, a literary paper fragment from 3rd/9th-century Egypt. The fragment contains a tradition that depicts ʿAlī b. Abī Ṭālib (d. 40/661) performing a four-rakʿa prayer and reciting a special supplication on the 15th of the month of Rajab. The tradition is only known from noncanonical Shīʿī ḥadīth collections. Situating it in a broader historical context, the paper provides a glimpse on the Shīʿī presence in Egypt as well as the sanctity of the month of (...) Rajab in Sunnī and Shīʿī literatures. This tradition, in conclusion, presents an early evidence for the observances of the month of Rajab in general and the middle of the month in particular in the local Shīʿī community in pre-Fatimid Egypt. Although there are fundamental differences between Ahl al-Sunnah and Shī‘a on the issue of Mahdī, one of the controversial issues among Islamic sects, Shī‘a has attached much greater importance to the issue. In this study, after the information about Mahdiship in the primary sources of Islam is conveyed, the opinions of the Ahl al-Sunnah and Shī‘a will be given and an evaluation will be made about the evidence and opinions put forward by the two sects. The Shiites, who formed the (...) principles of belief based on the theory of imamate, explained the issue of Mahdism in the axis of imamate and gave it a religious dimension, but the Shi‘ī sects disagreed on the subject of Mahdī. Shi‘ī sources tried to show that the claim of Mahdiship is an important issue, which has preoccupied Muslims, by dating the claim of Mahdiship back to Ali ibn Abi Talib's son, Muhammad ibn Hanafiyah. In a very early period, it was claimed that Muhammad ibn Hanafiyya did not die but was still living on a mountain called Razva in Madinah, and he was the anticipated (muntaẓar) Mahdī. Most of the Zaydiyya did not consider the issue of Mahdiship an important fundamental basis of belief. Ismailiyya maintain that Muhammad ibn Ismail did not die and will come and amend the world one day. Imāmiyya believe that Hasan, whom they accept as the last imam, will reappear as the Mahdī in the latest days of the world, and in line with this belief, they have made great efforts to find proof from the Qur’ānic verses and hadiths and interpreted them. In this way, they attached more importance to the understanding of Mahdiship on the axis of imamate than the other Shi‘ī sects. According to Imāmiyya, since the world cannot be left without a prophet, an open, or a secret imam, Muhammad b. Hasan will remain hidden as long as he wants and appear as the Mahdī near the Doomsday. Based on the clear statement of the Messenger of Allah (pbuh) that twelve caliphs would come after him, the Imāmiyya restricted the number of Imams from Ahl al-Bayt to twelve and claimed that the twelfth imam would come again as Mahdī. Although the Imāmiyya believe that the Mahdī will be from the Ahl al-Bayt, just like the other imams, they have not been able to provide valid evidence for the belief that the twelfth imam will be hidden and appear near Judgment Day. Although Imāmiya tried/have been trying to prove that it is possible for a person to live for centuries (more than a thousand years), which is called al-Ghaybat al-Kubrā by Imamiyya, it cannot be said that they have succeeded in doing so. ʻAlī b. Abī Tālib (d. 40/661), who took over the caliphate duty in a troubled environment after the murder of ʻUthmān b. ʻAffān (d. 35/656), first faced with the demands that the murderers of his murdered predecessor be punished. Although Hazrat ʻAlī himself was of the same opinion, he wanted to ensure public order in the city first. However, the Companions of the Prophet (aṣ-ṣaḥābah) like Zubayr b. al-ʻAwwām (d. 36/656) and Ṭalḥa b. ʿUbaydallāh (d. 36/656), who were not convinced (...) about this issue, started an opposition movement under the leadership of ʻĀ’isha bt. Abī Bakr (d. 58/678), who went to Mecca. The attempts of this movement, which got out of control with the participation of Umayyads and ʻAbdallāh b. Saba’ supporters of different intentions, ended with The Battle of the Camel. Before the war took place, Hazrat ʻĀ’isha heard the barking of dogs when the army led by ʻĀ’isha came to Hawaab on the road to Basra. For this reason, she asked where they were. When she heard that this region was Hawaab, she wanted to go back. Because the Hazrat Prophet had said the following before: "Which of you the Haw's dogs will bark for." The following statement is used in the ḥadīth sources in several different variants, generally without specifying a name: "Thereupon, the people with her wanted her to continue her journey, hoping that the Muslims would recover.” At this point, there is a difference between ḥadīth sources and Islamic historical sources. Islamic historical sources state that the people who wanted her to continue her journey were Ṭalḥa b. ʿUbaydallāh, Zubayr b. al-ʻAwwām and ʻAbdallāh b. al-Zubayr (d. 73/692). The following statements are included in another narration reported from Ibn ʻAbbās (d. 68/688) regarding the issue: The Prophet said to his wives: “I wish I knew! Which of you owns the beautiful hairy camel!” She will set out and then Hawaab dogs will bark at her, many people will be killed, right and left. Then she will survive when she is almost dead. A fifth piece of news mentioned within this framework was narrated by Abū Rāfiʻ (d. 40/660). According to this rumor, the Prophet of Allah said to Hazrat ʻAlī: "Something will happen between you and ʻĀ’isha." Hazrat ʻAlī said: "O Prophet of God! Me?" Allah's Prophet said: "Yes." Hazrat ʻAlī said: "Is it me among my friends?" Allah's Prophet said: "Yes." Hazrat ʻAlī said: "Well, did I trouble them?" The Prophet of Allah said: "No," and then added: "If such a thing happens, take her to a safe place." The sixth narration on the subject is a statement made by Ḥudhayfa b. al-Yamān (d. 36/656). Accordingly, Ḥudhayfa said: "Would you believe me if I told you that one of your mothers will set out with a group of Muslims and will fight you?" Those who were there said: "Will this really happen?" Ḥudhayfa said: "Yes". The last narration mentioned in this context is the news of Abū Bakra (d. 52/671). According to this narration: "Abū Bakra said: Immediately after joining the people of Camel in order to fight with them in the days of Camel, Allah helped me with a word I heard from the Prophet. When the news that the Persians appointed the daughter of Kisrā as the ruler reached the Prophet, the Prophet said: ‘The people who entrust their works to women will not find peace’. " In such a situation, it becomes important to analyze the narrations. Because analyzing the reliability of the narrators and the contents of the narrations will help to understand the subject in a healthy way. Although ḥadīth scholars make some different statements about the reliability of the people who narrated the narrations, the view that gains weight is that they are reliable. Likewise, no problem was detected in the contents of the narrations. Some problems draw attention when Islamic historical sources are considered. For, these historians were not as sensitive as ḥadīth scholars regarding the evaluation of the narrations. At this point, two problems draw attention: The transponder understanding adopted in the early stages of historiography. The effort to protect some valued people. Early historians generally adopted the transponder understanding while writing their works. For this reason, some misinformation that was not analyzed began to be passed down from generation to generation. At this point, the science of history should benefit from the methods of ḥadīth and its sound narrations. In addition, the effort to protect a valuable person like Hazrat ʻĀ’isha has brought the understanding of holding the Companions like Ṭalḥa b. ʿUbaydallāh and Zubayr b. al-ʻAwwām responsible for a behavior that is thought to be wrong. However, it should not be ignored that people can make mistakes. Loving Hazrat ʻĀ’isha does not require defending her wrong decision. In addition, this has brought the accusation of other Companions of behavior unbecoming to them. (shrink)

In this study, the classification of Zaydī fuqahā’ that emerged in the mutaaḫḫirūn period of Zaydī fiqh and related terms are examined. The book named Bulūgh al-arab wa-kunūz al-dhahab fī-maʿrifat al-madhhab, which has great importance among the studies aiming to present the Zaydī fiqh accumulation as a uniform doctrinal structure was taken as a basis in the processing of the subject. After an introduction in which Zaydī fiqh studies are evaluated in their relationship with the subject, the issue is handled (...) under three main headings. In the first title, the author and his work are introduced, and in the second and third titles, the methods and terms used in the classification of the Zaydī fukahâ are examined. The author of the work is ʿAlī b. ʿAbd Allāh al-Shaharī (d. 1190/1776) who lived during the period of the Qāsimī dynasty (al-dawla al-Qāsimiyya) in Yemen. The most important feature of the work, which was prepared using many sources that were attributed importance among the Zaydī literature, is that it was the most comprehensive of all that had written on madhhab doctrine until then. The first part of the work explains that the right madhhab to be followed is Zaydiyya. In the second part, the classes of the Zaydī fuqahā’, which is the subject of our study, are explained. The fuqahā’ classes are primarily divided into two parts: al-salaf al-ṣāliḥīn and al-ḫalaf al-ṣāliḥīn. The first dates back to the beginning of the 3rd/10th century. This class is divided into two parts, as al-sābiqūn and al-mutaaḫḫirūn. The sābiqūn starts with ʿAlī b. Abī Ṭālib, his two sons al-Ḥasan and Ḥusayn and ends with the sons of twelve imams who are their descendants. Zayd b. ʿAlī (d. 122/740) is one of the twelve imams. The most important of the faqīhs in the part of mutaaḫḫirūn, which started with al-Qāsim b. Ibrāhīm al-Rassī (d. 246/860), are the six imams called ahl-al-nuṣūṣ or aʾimma al-nuṣūṣ. The reason why they are named as such is that their words were taken as a basis in determining the views of the sect on the field of uṣūl and furūʿ l-fiqh. al-Qāsim al-Rassī is at a point where all the knowledge of the Prophet's family and the principles agreed upon by sābiqūn, reach him through many channels. al-Hādī Yaḥyā b. al-Ḥusayn (d. 298/911), grandson of al-Qāsim, is the most important imam in terms of his position in the madhhab. The ḫalaf al-ṣāliḥīn is also divided into two parts as ahl l-taḥṣīl and ahl l-naẓar. The first part also referred to as muḥaṣṣilūn or aʾimma al-taḥṣīl, has no subcategories. The second part is divided into two sub-sections as ahl l-taqrīr and mudhākirūn. The muḥaṣṣilūn class starts with those who catch up with the last class of ahl al-nuṣūṣ and ends with ʿAbd Allāh b. Ḥamza (d. 614/1217), one of the three important imams. Two other important imams of muḥaṣṣilūn are Aḥmad b. al-Huṣayn (d. 411/1020) and his brother Yahyā b. al-Husayn (d. 424/1032). It is the fiqh activity of the jurists of this class, called taḥṣīl l-madhhab, that brought Zaydī fiqh, which was fiqh of imams (madhāhib l-aʾimma) in its first period, into a single madhhab and to its classical form in the last period. Mudhākirūn jurists lived at the same time as the ahl-t-taqrīr. This period is about 700 years from the beginning of the 6th/12th century, which is the last century of the muḥaṣṣilūn class, to the end of the 12th/18th century, when Shaharī lived. The roles of the ahl al-taqrīr in the madhhab mostly consist of reviewing the works of the ahl-l tahṣīl, approving the correct ones, and correcting the wrong ones. That's why they are so named. The author of Kitāb l-Azhār, Aḥmad b. Yaḥyā l-Murtaḍā (d. 840/1437), is one of the prominent jurists among the ahl l-taqrīr. The majority of Zaydi fuqahā’ belong to the muẕākirūn class. These are the lowest class of the ahl-al-naẓar. As an important result reached in the study, it is possible to express the following: There is a difference between some of the knowledge and opinions in modern Zaydī studies, which include the same subject as Shaharī's work, in terms of the classification of Zaydī fuqahā’ and the terms used. Therefore, the findings and conclusions based on this work should be confirmed by new studies on other Zaydī classics, and existing opinions on Zaydī jurisprudence should be reviewed. (shrink)

This study seeks to investigate the treatise of Abū al-Hasan b. Abd al-Rahman b. Muhammad al-Khatīb al-Shirbīnī al- Shāfiʻī (d. after 1028/1619) entitled Fatḥ al-Raḥīm al-Raḥmān fī tafsīr Āyat "inna Allāha yaʼmuru bi al-ʻadl wa al-iḥsān" based on the manuscript of the author. Shedding light on the translation of this unknown scholar, as it is evident from the title of the treatise that it contains the interpretation of this verse, which is well known among scholars and commentators as the most (...) comprehensive verse in the Qur’ān. In this tafsīr, Shirbīnī used many exegetical methods such as exegesis of the Qur'ān with the Qur'ān, exegesis of the Qur'ān with the Sunnah, exegesis of the Qur'ān with the sayings of the Companions, and al-tafsīr bi-al-raʼy, as well as tafsīr approaches such as linguistic tafsīr, the science of munāsabāt, and causality of nuzūl to analyze the meanings of the verse in depth. Another feature that increases the importance of this treatise is that al-Shirbīnī refers to the primary source tafsīr books together with their glosses, sometimes quoting from the commentators verbatim, and sometimes making meaning-based quotations from them, which is the most obvious indication of his exegetical ability and scholarly competence. In this work, he adopted a syncretic approach while emphasizing the meanings of the verse and followed an analytical-critical method while examining the subject. For this reason, he analyzed all the words in the verse one by one, dwelt on the meanings and interpretation of the words, and criticized their views after including the views of the commentators. Therefore, he applied the analytical exegesis method very successfully in this work. Accordingly, he analyzed the narrations related to tafsīr and mentioned the Companions' names during the narration. In particular, he analyzed the narrations from Ibn 'Abbas (d. 68/687-88) about the words al-ʻAdl and al-iḥsān, and stated that there was a dispute between the narrations about the phrase al-iḥsān. He took a scientific stance on the derivation of the word "Allah,” debated between those who accepted it and those who rejected it. He stated that the derivation of the word was not satisfactory and reliable. In the tafsīr of the words al-ʻAdl and al-iḥsān, he discussed the isnāds in Muqātil b. Sulayman’s (d.150/767) tafsīr emphasizing that he received the tafsīr of al-ʻAdl from Ibn 'Abbas and the tafsīr of al-iḥsān from 'Ali b. Abī Tālib. This approach is an important example for the isnād analyses of Muqātil b. Sulayman who was criticized for neglecting isnād chains in his tafsīr. He also criticized al-Baydāwī for being influenced by some of Zamakhsharī's sectarian and theological views. He classified the issue of kinship according to usūl, furū', and hawāshī, expanded the meaning of the verse, and insisted that the message of this verse encompasses all relatives, regardless of the degree of kinship. He was influenced by Latāʾif al-Ishārāt, al-Kashshāf, Mafātīhu al-ghayb, al-Baydawī, Hāshiya al-Jurjānī ala al-Kashshāf, and his grandfather al-Khatīb al-Shirbīnī’s (d.977/1570) al-Sirāj al-munīr. ʿAlī fils d’Abū Ṭālib, gendre et cousin du prophète Muḥammad, premier imam (chef, guide, leader) des Shi’ites et quatrième calife, est sans doute une des figures les plus centrales de différents types de spiritualité en islam. Cependant c’est surtout dans la spiritualité shi’ite, fondée principalement sur la figure de l’imam, qu’il constitue le véritable pivot autour duquel gravitent les doctrines religieuses les plus importantes. L’article envisage ce rôle à travers une problématique précise, celle des rapports qui lient la figure de (...) ʿAlī au Coran. Ainsi, sont examinés respectivement les rôles de ʿAlī d’abord comme acteur et sujet de l’exégèse de la Révélation, ensuite comme contenu et objet ultime de celle-ci. Cette dimension duelle semble s’appuyer sur la double nature, humaine et divine, de ʿAlī. C’est la raison pour laquelle l’article se termine par l’hypothèse de l’identification possible, par certain proto-Shi’ites, entre leur premier imam et le Christ. (shrink)

We can begin with a story. In his account of the reign of Harun al-Rashid, al-Tabari spends considerable time on the matter of Yahya ibn Abdallah. Scion of the family of ‘Ali ibn Abi Talib, Yahya was the leader of a group active in Daylam, a region in present-day Iran. Al-Rashid and other Abbasid leaders laid claim to the territory, but at the time (the 790s) they did not have effective control over it. Ever-sensitive to the challenge presented by (...) sentiment favoring the house of ‘Ali, al-Rashid and his advisers devised a scheme by which the ruler of Daylam received payment for persuading Yahya to turn himself in. He did so, but only on the condition that al-Rashid provide him with a writtenaman, or guarantee of security. (shrink)

The third century of the hegira represents an extremely important period in terms of the formation process of Islamic sciences and the acquirement of the identity of a systematic school of fiqh madhhabs. In terms of the Zaydiyya madhhab, this century has an identity that affects the next period in terms of both political and scientific studies. Because in this period, the scholars of the madhhab like Kāsim al-Rassî (d. 246/860), Ahmad b. Isā (d. 247/861) and Yahyā b. al-Husayn (d. (...) 298/911), who were in a leading position both in politics and in sciences such as kalām, hadith and fiqh, emerged. Kāsim al-Rassî, who was accepted as the star of the Ahl al-Bayt by Zaydî sources in the first period, was presented as the Plato of Muslims by orientalists in modern studies. The main reason why today's studies on him are mostly about the history of sects and theology, most of Rassî's works are about kalām. However, Kāsim al-Rassî is an important name in the science of fiqh and İslamic legal theory as well as in the science of kalām. According to Abī Tālib Nātik bi’l-Hakk (d. 424/1033), one of the important jurists of the Zaydiyya madhhab, Rassî was a scholar who came to the fore with his ability in fiqh issues; in order to see his ijtihād method, his skill in furû al-fiqh, his mastery in using hadiths and knowing the disagreements of scholars, ‘‘Masā’il al-Dja’far b. Muhammad and Abd Allah b. Hasan” should be consulted. Rassi's epistles named Kitab al-Nāsikh wa’l-Mansūkh, Kitab al-tahāra, Kitab al-salāt al-yevm ve al-Laylā and Kitab al-menāsik are important studies on fiqh that have survived to the present day. In addition, Mueyyed-Billah (d. 411/1021) compiled Kāsim al-Rassî’s and Yahya b. al-Husayn's views on fiqh in his work named al-Tecrîd. Kāsim al-Rassî's views on fiqh are also determinative in later fiqh books such as Tahrîr, al-Cāmi' al-Kāfi, al-Intisār and al-Azhar. In time, the emergence of a jurisprudence sect named Kāsimiyya in Zaydiyya, referring to his name, is also important in terms of revealing his position. Although Rassî's views on fiqh have been referred to a number of studies in our country, no independent study has been found that deals with his views on fiqh. However, considering both of his works on fiqh that have survived to the present day and the early works in which his views are compiled, it is obvious that Kāsim al-Rassî's views on fiqh deserve an independent works. The aim of this study is to reveal Ressî's position within the madhhabs and his perspective on fiqh in general. In this context, in the study, the period in which Ressî lived, his life and works were briefly mentioned, and then the basic views of the fiqh, especially in the field of worship, were discussed in outline. Los marabouts, o morabitos, son líderes religiosos de las cofradías musulmanas sufíes africanas. A ellos deben obediencia los talibes, discípulos, tanto en sus lugares de origen como en la diáspora migratoria, de gran intensidad y tradición en el muridismo. Los marabouts, con sus visitas recurrentes a los diversos lugares de migración, articulan la identidad colectiva a la par que recogen divisas para regresarlas a Senegal, redistribuyendo y también ejerciendo de �grandes hombres�, ricos, dadivosos y santos, moviéndose en el capitalismo financiero (...) contemporáneo con recursos y tradiciones propios. Sus roles se analizan de modo complejo por parte de los estudiosos, a veces como figuras de dominación e incluso de explotación laboral hacia los discípulos; otras veces, como líderes movilizadores de capital social, cultural y económico, cuyas obligaciones redistributivas y morales compensan sobradamente el esfuerzo de la comunidad. Aquí se pretende recoger precisamente la densidad de este debate, y dado que las funciones marabúticas caminan entre las prácticas culturales emancipatorias y dominantes aparentemente a la par. This paper constructs the theological polemic among Near Eastern Christian sects and the encounter with the new religio-political regional power: Islam. Focusing on the period from around the first Muslim conquests in the mid-seventh century until the ninth centure C. E., a list of East Syriac Church Fathers and their writings are selected as representative voices in the continuing Christological debates. In particular, the paper is concerned with how theological arguments were first used and reinterpreted to address conversion to Islam (...) and later used to emphasize, in an ironic twist, the proximity between Nestorianism and Islam contra other Christian “heresies”. This historical development is important to understand how Nestorian literature was later used by Muslim theologians well after the ninth century, such as Ibn Abī Ţālib al-Dimašqī in the fourteenth century, to defend Islam and debunk Christianity. For Nestorian apologetics the immediacy of addressing the issue of Christian conversion to Islam was clear. Letters from Nestorian clergy, such as Katholikos Īšō’yahb III. and Katholikos Georg, recount the old debates among Nestorians, Miaphysites, and Melkites concerning the nature of Christ. In order to explicate best the erroneous attraction of Islam, these two men contextualized Islamic theology as similar to a Christian heretical sect. Yet over time, appealing to Islamic overlordship became necessary. With the rise of the Abbasid caliphate and the establishment of its capital in the historical heartland of the Nestorian Church, the polemic was reversed. Hereafter, Nestorian dyophysite doctrine was used as an appeal to the Islamic conception of Christ’s divinity. For example, Katholikos Timotheos I. and the theologian Theodor Bar Koni underlined the blasphemy of the Miaphysite and Chalcedonian Christology. This very tactic, however, was easy for Muslim scholars to appropriate in Islamic apologetics. Well before al-Dimašqi, the words of the Abbasid Caliph al-Mahdi to Timotheos are distinct: the Nestorians understood correctly that God could not have suffered and died, but that they all were still wrong that Jesus is the Son of God.
